

Why the Insurance Company Won’t Pay (Part 2)
Ok, let’s look at some more excuses. Another common area of excuse deals with the condition of your car and the severity of the crash:
“You had equipment defects such as: bald tires, bad breaks, your taillights were not working, no turn signal…”; “You didn’t have your seatbelt on”;
“Your headrest was at the wrong height”; “Their was little or no damage to one or both vehicles”;
“You had a new car which means it had shock absorbing bumpers, headrests were at the right height and a proper seatbelt, so you couldn’t have been hurt”;
“No one else in either car was injured”; “The defendant was going less than 5 mph”; “The repair estimate was only a few hundred dollars”; and “No one’s airbag went off”.
Usually the Insurance Company will also use your medical condition and history against you: "You made errors in recalling your medical history, which means you were not honest";
"You had prior complainst to the same areas of the body"; "You have had previous medical treatment for the same problem"; "You previously treated with a Chiropractor";
"You had a subsequent accident that is actually causing all of your problems"; "You had no pain complaints at the exam by the Insurance Company doctor";
"You have had mental health treatment before, so this is all in your head"; "You were not wearing your glasses or hearing aid"; "You have an underlying medical condition which
impairs your ability to drive (epilepsy, migranes, etc.).
A good personal injury attorney knows how to combat these arguments.
