Here are a few more excuses the insurance companies use to not pay or delay your claim:
Using your memory or actions against you - You didn't notice the Defendant until immediately before impact, so you must not have been paying attention; You don't remember all the details of the accident, so you were inattentive or incompetent and therefore not credible as a witness; You exagerated the speed of the vehicles so you are an unreliable witness; There are no witnesses to confirm your story or they found a witness that disputes your story; The physical evidence is lost (car was destroyed) so we can't prove what happened. Making you or someone else the bad guy - You could have avoided the accident but weren't paying attention or you were speeding; You made an unnecessary unexpected stop; You didn't use your turn signal, or your brake lights did not work; A phantom vehicle was responsible; The accident was unavoidable; There was an emergency that excused the Defendant's speeding; The police officer made mistakes in his report. The accident had no significant effect on you - Your doctor did not say you could not work; You often miss time from work anyway; You were unemployed and could not find a job anyway; Your tax records show you make less money than you claimed; You were paid in cash for your work and did not report the income. And finally - The cost of your medical treatment was excessive; Your injuries should have entirely healed in a few months; You went to work against doctors orders making yourself worse; You have a history of filing lawsuits and making claims like this; You have a history of emotional problems.
The bottom line to almost all of the excuses from Insurance Companies is that "you are a liar" or "you won't be able to prove it to a jury". In 25 years I've seen a lot of this, and they come up with new excuses all the time.
