

A: There is no magic formula or exact scientific process by which an attorney can determine the amount of money a person is entitled to receive in any particular case. This is especially true when damages must be determined for subjective elements such as pain and suffering and loss of the capacity for the enjoyment of life. However, I will usually have a pretty good idea of a reasonable settlement range after your medical condition has been finalized and we determine the effects all of this has had on you. We have to look at factors such as the extent and permanency of your injuries, the effect these injuries have had on your life including loss of income, the amount and duration of your medical treatment, prior jury verdicts and/or arbitration awards received for similar injuries and my professional judgment. Ultimately, if there is no settlement, the value of any given case will be determined by the jury's verdict after a trial on the merits.
