What should I do following an accident?

This is the most common question I am asked, and there are several things you can do to help protect your legal rights. Here are a few of the most important:

1) Take Notes - After an accident, it is very helpful if you keep a written record or journal of some kind. If you have been injured, ask a friend or loved one to help with the note taking. Start this process immediately, including recording the details of the accident.  This can strengthen your claim and avoid confusion later.

Remember to include the following information if applicable: time, place, individuals involved or witnesses including phone numbers, quotes from conversations, the details of the accident and anything else that you think might be important. In the days and weeks following, you should continue taking notes of your injuries (both physical and mental), medical treatment you received and the effect the injuries are having on your job and personal life.

2) Preserve Evidence - Try to obtain any evidence that can help your case. It is important to act soon as witnesses often forget details and accident scenes can change over time.

So take pictures of the scene, your injuries and vehicle damage. Cell phone photos work fine. 
Keep all of your medical records related to the accident, as well as property damage estimates and police reports.
If you were injured by a defective product, obviously keep the product and any instructions, labels, warning information and packaging that came with the product, and if possible, the receipt.

3) Talk with a Personal Injury Attorney - it's important to meet with a personal injury lawyer so you can understand your legal rights. 

What NOT to Do Following an Accident
Do not move your vehicle unless its location is unsafe.
Do not leave the scene of the accident until a law enforcement official tells you to do so.
Do not throw away potential evidence, such as a defective product.
Do not discuss fault with the other driver.
Do not apologize. In some cases, this can be an admission of guilt.
Do not sign a settlement agreement without speaking with a personal injury attorney first, especially if one is offered to you by an insurance company shortly after the accident.
