Drunk drivers cause thousands of accidents on our roads each year. If you are the victim of a car crash caused by a drunk driver, you should focus on 2 key things: getting the medical help you need and getting legal advice from a Florida personal injury attorney.

Following a car crash caused by a drunk driver, you might not feel as though you Are injured, but it is still a good idea to see a doctor. There are many types of injuries that may not present themselves immediately. For example, some brain injuries do not show symptoms right away, but they can end up leading to serious cognitive and motor problems, and sometimes even coma and death.

Other serious “invisible injuries” include the following:

    •       back injuries;
    •          neck injuries, like whiplash;
    • injuries to the joints (shoulders, hips, knees, etc.); and
    •       internal bleeding.

It is important not to delay being checked by a physician after a car crash. Do not try and minimize your injuries thinking that you are “just sore”. This is a mistake many people make that later has a negative effect on their overall health as well as on the success of their injury claim. Be sure to bring your medical reports with you when you see your Florida personal injury attorney.

Contacting a Florida Personal Injury Attorney

If you've been injured by someone driving a vehicle under the influence, call a caring, knowledgeable lawyer.

Just heard a radio report that a large new study reveals that Teens that drive with other Teens in the car are more likely to have an accident than if they were riding with adults. I'm sure this comes as no surprise (certainly not to me as I've been dealing with auto accidents for 27 years in St. Petersburg), but the details make it something to think about. The study found that the more Teens in the car, the higher the accident rate, so it is more dangerous to have your Teen driving with 3 of their friends in the car as opposed to just 1. An even lower rate was found when the Teen drives alone. Again no surprise, as there are less distractions, and no one to "show off" for. Also, if an adult is in the car, the rates go down. Again no surprise, as the adult will also lessen the likelihood of disctractions.
Something to think about when you give your Teen the car keys!

What To Do Immediately Following a Motorcycle Accident in Florida

The hours following a motorcycle accident are crucial to your health. They are also vital for building your Florida personal injury case, should you be considering pursuing one.

Your first step after a motorcycle accident is to remove yourself from danger. If you're able to move, get yourself away from traffic and from any sources of fire, like spilled fuel.

Get medical attention. Some injuries are fairly easy to see and feel, while others can be more difficult to detect right away, and they can be serious over time. Also, the adrenaline that kicks in at the time of an accident might keep you from fully feeling pain and discomfort for a period of time.

Report the accident to the police as soon as possible. Many times, motorcycle accidents end up being blamed on the cyclist rather than the driver of the passenger vehicle. It helps to have your telling of events on record early on.

Watch what you say to the other driver(s) involved. Don't verbally attack them, and don't say anything that could be interpreted as an admission of fault. Just stick to exchanging information at the scene.

Call a reputable Florida personal injury attorney. Having a lawyer on your side as soon as possible can help you through the stressful time following a motorcycle accident.

Contacting a Florida Personal Injury Attorney

The law firm of William K.
An annular tear is a serious back injury that occurs when the outer protective layer of a vertebra, called the annulus fibrosus, rips or tears open, allowing the inner liquid to spill out onto the surrounding nerves, causing extreme pain and discomfort.

An annular tear can be caused by:

normal wear and tear;

high-impact sports; or

a great force, such as that from a car accident.

If you have suffered a back injury in a car accident, it would be a good idea to discuss your legal options with a St. Petersburg injury attorney.

Various Forms of an Annular Tear

If you suffered an annular tear due to a recent car accident, it’s important to be aware of the different types of tears that are possible so you can receive the best treatment.

The first type of annular tear is a cervical annular tear. This type occurs in the upper portion of the spine, near the head and neck, and is often called a herniated disc.

The second type, the lumbar annular tear, is a herniated disc that occurs in the lower portion, or lumbar section, of the back. Symptoms for this tear include:

severe pain or sensitivity in the spine;

tingling in the extremities; and

weakness.

The third type of annular tear, the small annular tear, is a bit different. The small annular tear is essentially a pinched nerve, occurring when the inner material surrounding a vertebra squeezes out through a small tear and pinches or puts pressure on the nearby spinal cord.

Getting Lost Wages & Medical Bills Compensated

If your recent car accident left you with an annular tear, endless medical bills and days of lost work wages, you could be entitled to compensation.
For 90 percent of patients with ruptured disc injuries, conservative treatments such as exercise and activity modification is sufficient to reduce symptoms, according to Mayo Clinic. However, in more severe cases, such as one involving a serious car accident, surgery may be required.

If you suffered an accident injury as the result of someone else’s negligence or reckless behavior, they may be held legally liable for your injuries and the medical expenses you accrue. You’ll want to speak with a St. Petersburg personal injury attorney to determine exactly what your options are.

Surgery is also an option when:

disc fragments lodge in the spinal canal, causing increased weakness;

walking and standing for any length of time is cumbersome; and

it becomes difficult to perform regular daily activities.

If the entire disc must be removed, surgeons may have to fuse the vertebrae with metal hardware or implant an artificial disc.

If you’ve suffered a traumatic car accident injury, your focus during the aftermath should be on healing your body, and trying to get your life back to normal. Financial and legal concerns will only exacerbate matters.

One of the best things you can do is to take your case to a St. Petersburg personal injury attorney and allow him or her to help you handle the legal aspects of your accident.
When it comes to Florida personal injury claims, there are some things you may not know. The decision to file a claim after a St. Petersburg accident is an important one. To ensure your rights are protected, you would benefit in seeking help from an injury claim lawyer who handles car accident cases.

The first thing you may not know about Florida personal injury claims is that the insurance company isn’t looking out for you. Despite how pleasant the claims adjuster may sound, he or she isn't keeping your best interests in mind.

The goal of the insurance company is to pay out as little as it can or nothing at all. This is why securing legal help is important, which can improve your chance at receiving a settlement that’s fair.

The second thing you may not know is that most cases settle within 8-12 months. Don’t make the mistake of assuming that it takes too much time and isn’t worth the effort of filing a claim.

When you’ve been seriously injured and you face medical expenses and lost income, these costs may be compensated. You also could be entitled to other damages.

The third thing you may not know is that seeking help from an injury claim lawyer is the best way to protect your claim. A lawyer also can explain to you some of the myths surrounding Florida personal injury claims. By speaking with a lawyer, you can learn if you have a valid claim worth pursuing.

Obtaining the Help of an Injury Claim Lawyer in St. Petersburg
Filing an injury claim as the result of a car accident in St. Petersburg can be complex.
5 Things Not to Say After an Accident in St. Petersburg

After a car accident in St. Petersburg, the scene can be chaotic and confusing. In the commotion of the moment, you could say something that later could be held against you or taken out of context by an insurance company. St. Petersburg accident lawyers will usually advise you to speak only when necessary at the scene. These are 5 things you should never say after a car accident.

“I didn’t see you” – It could be that you didn’t see the other driver because he or she ran a red light or didn’t have lights on. Saying this can make it seem like you weren’t paying attention.

“I’m Sorry” – If you aren’t sure if the accident in St. Petersburg was your fault, don’t say anything. “I’m sorry” can imply fault.

“I’m OK” – Even if you don’t have external injuries, you may have internal injuries that can show up later.

“We don’t need to call the police” – If you don’t call the police after an accident, you could face legal action and miss an opportunity for third-party documentation of what happened.

“It was your fault” – Don’t try to speculate to the police or insurance adjusters what caused the accident. Let the St. Petersburg accident lawyers assigned to your case handle proving fault.

Remembering these 5 things can help you avoid making common mistakes after an accident in St. Petersburg. Protect your legal rights and maximize the amount of compensation you may receive by contacting an attorney.

Contact a St. Petersburg Accident Attorney

Filing a personal injury claim as the result of a St. Petersburg accident can be complex.
Can I make the insurance company repair my car with new OEM parts?

I am often asked if the insurance company has to repair a wrecked car with new OEM "Original Equipment Manufacturer" parts. The short answer is probably no, unless the insurance policy requires it. Florida law requires the parts to be of the same fit, quality and performance. This technically provides 3 options: new OEM parts; used OEM parts; or non-OEM parts. While the insurance company will argue that your 5 year old car doesn't deserve a brand new radiator, and if they can find a used 5 year old OEM radiator, putting it in your car places you back in the same situation you were in before the accident. Your response to that argument should be to ask what guarantee they will give you that the replacement radiator is of the same fit, quality and performance as your old one? If they want to use a non-OEM, generic or after-market part, whether new or used, you should ask the same question, then add these questions: Are these parts covered under my warranty? Are these parts crash tested? Are there any provisions for recalls based on saftey or performance, or non-performance of these parts? Get an independent repair center to advise you if you can. And do as much of this as possible in writing, so you have some evidence if things turn out badly after the repairs are completed. The problem, and the big advantage the insurance companies have in this situation, is that most people need their cars back as soon as possible, and they know you might not have the time to fight with them since you need to get back to work. As a St. Petersburg trial attorney I deal with wrecked cars all the time, and routinely put insurance companies on notice, in writing, that those repairs better live up to the insurance policy and the Florida statutes.

How Much Is My Personal Injury Case Worth?

Determining the value of a personal injury case in St. Petersburg, Florida, or anywhere else for that matter, is very difficult, as there is no magic formula. It helps to have 27 years of trial experience to come up with a general range, but since every injury effects every person differently, and every jury is made up of a different mix of people, no one can give you an exact answer. If they say they can, run away!

In simple terms, your case is worth the amount of your damages, which include your out of pocket medical bills; your potential future medical bills; your past and future lost wages; and your past and future pain and suffering. You are also entitled to be paid for any damage to your personal property, such as your vehicle. Past medical bills are usually pretty clear cut, but even those can cause battles between you and your own insurance company. Future medical bills can be predicted by your treating doctors, but anything in the future is always just an educated guess. Showing lost wages can be as simple as showing prior paychecks compared to future ones, or can be extremely complicated if you own your own business, or had the potential to earn more than you had been making. Finally pain and suffering is the most difficult thing to prove. There is no "pain-o-meter" machine to plug you into to prove how much you hurt. This usually depends on the testimony of the client, and frankly, how believable they are.

As a trial attorney, I am always looking ahead to what a jury would think. It is not always fair, but we don't go to the "fairhouse", we go to the "courthouse" and perception is most important. A significant amount of property damage, and going to the hospital or a doctor immediately are often important to a jury. Obviously the amount of treatment, and wheather the treatment is painful, such as injections, or significant, such as surgery, are likely to make a jury think "Wow, they must have really been hurt to go through that!".

Finally, the effect on you can be tremendous. As an example, if I had a severe hand injury, it would be inconvient, but I could still do my job as a lawyer. If I was a carpenter, or a surgeon, or a professional musician I might be completely out of work forever.

An experienced trial attorney puts all these factors together to put your case in the best light in dealing with the insurance company, or presenting it to the jury. It is not always possible to give an exact prediction of outcome, but the real job is getting the highest offer possible on the table, or getting the highest amount your particular jury is willing to give.

Riding a motorcycle can be a thrilling experience but also a dangerous one. If you’re in a St. Petersburg motorcycle accident you could experience multiple injuries, some of which can be fatal.

You may be smart when riding your motorcycle; however, we know that not all accidents are avoidable. If you’ve been in a motorcycle accident you should speak with an accident lawyer in St. Petersburg to find out what recourse you can take.

Motorcycle Safety Tips

Riding a motorcycle doesn’t have to be hazardous if you follow some guidelines for safe motorcycle operation. First, take a motorcycle training course.

Look up local classes in your area for motorcycle training to give yourself a well-rounded education on how to work and drive the bike the proper way. Some states will require that you obtain a special motorcycle driver’s license and that includes taking a training course.

Second, wear protective clothing. Many injuries in a St. Petersburg motorcycle accident can be lessened or avoided by wearing protective motorcycle gear:

helmet;

leather;

long pants;

shirt-sleeves;

sturdy shoes; and

gloves.

These items should also be brightly colored or accessorized with reflective strips so that you’re highly visible when riding at night. Keep these tips in mind if you’re thinking of purchasing a motorcycle or if you’re going out for ride. What may seem like small measures could save your life.

When it’s Time to Contact an Accident Lawyer in St. Petersburg

After a St. Petersburg motorcycle accident you could be injured. Filing a personal injury claim as the result of a motorcycle accident can be complex. Contact a lawyer in St. Petersburg to learn if you have a valid claim worth pursuing.

The long-term consequences of the loss of a limb will depend on several factors, including early medical care and management of the injury. It will also depend on future medical treatment that is received, with more advanced care improving the chance of a victim getting his or her life back together.

With new surgical techniques, early rehabilitation and improved design of prosthetic devices, it is possible for an injured victim to learn how to function well and experience a good outcome.

However, all of these interventions are extremely expensive. So when an accident is caused by the careless or reckless actions of another party, they may be held liable.
