Traumatic Brain Injury Caused By Slip and Fall Accident

Traumatic brain injury, also known as TBI or head trauma, is a serious condition that is often caused by a fall. According to the Brain Injury Association of America, falls are a leading cause of traumatic brain injury and account for 28 percent of TBI cases each year. If you have sustained a traumatic brain injury, which resulted from a fall, you need to be aware of your legal rights.

What is traumatic brain injury? It is defined as an injury caused by “a blow or jolt to the head or a penetrating head injury that disrupts the function of the brain.” This injury occurs when a sudden trauma causes damage to the brain. Brain damage can range from mild to severe, depending on the cause of the traumatic brain injury.

Every year, 1.4 million people sustain a traumatic brain injury and among those injured, 50,000 will die, 235,000 will be hospitalized and 1.1 million will be treated and released from emergency departments. The Centers for Disease Control and Prevention estimate that at least 5.3 million people in the United States currently have a long-term or lifelong need for help to perform daily living activities.

Traumatic brain injury can lead to a wide range of problems for the victim, as it affects thinking, language, learning, emotions, behavior and/or sensation. It has been known to cause epilepsy and increase the risk of developing other serious conditions, such as Alzheimer’s disease, Parkinson’s disease and other brain disorders. As a person ages, these conditions can become more prevalent.

Little can be done to reverse the damage to the brain in a fall accident, but medical treatment is still recommended for TBI victims to prevent further complications. After a slip and fall accident, a doctor will perform various tests, including x-rays and CT scans to determine the extent of the damage to the brain. Surgery and rehabilitation are sometimes required to improve the victim’s condition.

If you have been injured in a slip and fall accident and have sustained head trauma as a result, you may be able to recover damages to pay for your medical expenses, lost wages and other costs associated with your injury. Depending on the details of your case, the property owner may be held liable. Contact an experienced Florida slip and fall attorney at the Law Offices of William K.
