Cleveland Browns wide receiver Donte Stallworth was confirmed to be legally drunk when he hit and killed a man on the MacArthur Causeway last weekend. He had a reported blood alcohol level of .14 percent, which is nearly twice the legal limit in Florida of .08.
According to police, Stallworth was driving toward the beach when he hit and killed Mario Reyes with his Bentley. Reyes was near a crosswalk, but it is unclear if he was crossing legally. He had just finished his work shift and was crossing the street to catch a bus home when Stallworth hit him.
Reyes was married for almost 20 years and has a 15-year-old daughter.
A spokesman for the Miami-Dade State Attorney’s office said that Stallworth’s case is being reviewed by prosecutors, but would not comment as to whether or not his blood alcohol test results were in.
The Miami Herald quoted a source who had knowledge of the investigation. According to the source, Stallworth’s blood alcohol tests “showed he was over the legal limit.”
A reporter from CBS4 contacted Stallworth’s attorney Bob Switkes who refused to speculate about the case or make any comments because he had not received the results of the blood alcohol test. Switkes is expecting to receive the results from the test on Friday and he told the CBS4 reporter that “I’ve heard the reports but I am not going to speculate or comment until I see what the results are.”
The same reporter attempted to reach Stallworth, but was not successful. However, Stallworth did release a statement that he was “grief stricken” over the accident that killed 59-year-old Mario Reyes.
