Times are Tough for Family of Boy Injured on Baywalk

A boy from St. Petersburg is permanently brain damaged due to a freak accident that occurred on Baywalk.  In February 2007, Josiah Wineberger was struck on the head by a large speaker that fell from the second floor stage at Baywalk.

Since the tragic accident, Josiah is not potty trained, cannot straighten his fingers of one of his hands and often awakens in the middle of the night.  Josiah is now 4-years old and talking.  However, according to his father, “He’ll say something, and then his mouth will move with nothing coming out, repeating what he said but not saying it out loud.  And that’s due to the brain injury.”  The Wineberger’s have filed a lawsuit against Baywalk, which is still pending.

In addition to coping with their son’s injury, the Winebergers have been faced with many more challenges.  Their only vehicle has broken down and their rental home is in foreclosure. 

John Wineberger became a stay-at-home dad following his son’s accident, so he could take Josiah to various therapies.  He also drives his wife to work and his three other children to school.  He is not sure what they will do now that their family minivan is not operating.  “It’s broke down and it’s done.  For a head gasket, I think it’d probably run easily three or four thousand dollars.”

To make matters worse, Wineberger received a letter the day before Thanksgiving informing him that his rental home is in foreclosure.  The letter was from his landlord’s bank and stated that they must be out of the home by January 11th.  Wineberger is hoping to find a landlord who will waive the first and last month rent and deposit requirements.  As far as his vehicle, he is still not sure what to do about transportation.
